These Terms of Use govern access to Orbait’s websites, accounts, exam-preparation tracks, simulations, explanations, progress tools, AI-assisted features, emails, and related services. By creating an account, purchasing access, or using the Services, you agree to these Terms.

Orbait provides structured educational tools for pesticide applicator exam preparation. These Terms explain what access includes, how purchased content may be used, what happens when rules are violated, and the limits of an independent study platform.
One account, one learner
Your login and purchased access are personal, limited, nontransferable, and may not be shared with coworkers, classmates, or another business.
Preparation—not certification
Orbait helps you study, but official agencies and testing providers control eligibility, exams, passing scores, certification, and licensing.
Clear access periods
The product page and checkout identify the price and access period. Unless explicitly stated, purchases do not automatically renew.
No copying or redistribution
Questions, explanations, designs, analytics, software, and study structures remain Orbait’s protected intellectual property.
Acceptance and scope
These Terms of Use (the “Terms”) form a binding agreement between you and Orbait LLC, a Connecticut limited liability company (“Orbait,” “we,” “us,” or “our”). They apply to websites, account areas, study tracks, quizzes, simulations, explanations, progress tools, AI-assisted features, communications, and other services operated by Orbait that link to these Terms (collectively, the “Services”).
By accessing or using the Services, creating an account, or purchasing access, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not access, purchase, or use the Services.
Eligibility, registration, and account security
You must be legally capable of entering into a contract where you live. Users under the age of legal majority may use the Services only with the involvement and permission of a parent or legal guardian. Orbait is not directed to children under 13.
- Provide accurate and current registration, billing, and contact information.
- Maintain one personal account unless Orbait expressly authorizes another arrangement.
- Keep your password confidential and use reasonable safeguards for your email account and devices.
- Notify Orbait promptly if you suspect unauthorized access, credential sharing, or account compromise.
- Accept responsibility for activity conducted through your account, except where caused by Orbait’s own failure to use reasonable safeguards.
Orbait may require password resets, additional verification, or other reasonable security measures. You may not impersonate another person, use misleading information, or create accounts to avoid restrictions, payment obligations, suspension, or refund limits.
Independent educational purpose
Orbait is an independent educational and exam-preparation platform. Orbait is not a pesticide regulatory agency, licensing authority, testing provider, government contractor, or accredited certification body unless a specific page expressly states otherwise.
- Completing an Orbait track does not register you for an official exam or establish examination eligibility.
- Orbait does not issue government licenses, certifications, continuing-education credit, or authorization to apply pesticides.
- Practice questions are educational materials and are not represented as confidential, copied, recalled, or official examination questions.
- Exam rules, manuals, laws, fees, categories, passing scores, and procedures may change without notice to Orbait.
- You remain responsible for reviewing the latest materials and instructions issued by the authority that governs your exam.
Purchases, payments, and access periods
Prices, products, included features, access periods, and any promotional conditions are shown on the applicable product page or checkout. You agree to pay the amount displayed at checkout, including applicable taxes or fees disclosed before purchase.
- Payments may be processed by Stripe or another third-party payment provider.
- Orbait may receive transaction status and limited billing information but does not require you to send complete payment-card numbers directly to Orbait support.
- Access begins when payment is successfully processed, unless the product page states another start date.
- Access expires at the end of the period displayed at purchase. Expiration may remove access to content, saved progress, or premium features.
- Unless the checkout expressly states that a purchase renews, Orbait purchases are not automatically renewed.
- If a payment is declined, reversed, refunded, disputed, or determined to be unauthorized, Orbait may delay, suspend, or remove the corresponding access.
Prices and product configurations may change prospectively. A price change does not retroactively alter a completed purchase, but it may apply to a later purchase, extension, upgrade, or renewal.
24-hour risk-free refund policy
Orbait offers a 24-hour risk-free period for eligible purchases. If the purchased product is not the right fit, you may request a full refund within 24 hours after the recorded purchase time by emailing support@orbait.com from the email address associated with the account.
- The request must be received within the 24-hour period.
- Once a refund is approved, access to the refunded product may be removed immediately.
- The refund applies to the amount actually paid for the eligible product, excluding any amount not collected by Orbait.
- Requests involving fraud, credential sharing, copied or downloaded content, repeated purchase-and-refund behavior, or other abuse may be denied to the extent permitted by law.
- After 24 hours, purchases are generally final unless a different written policy applies or applicable law requires otherwise.
Conditional Pass Policy
Certain Orbait products may be expressly advertised as including the Orbait Pass Policy. For an eligible product, a learner who does not pass the corresponding official state pesticide applicator exam on two separate attempts may submit a claim for a refund of the amount actually paid for that product, subject to every requirement in this section. The Pass Policy is a conditional refund benefit—not a representation, warranty, or promise that a learner will pass.
Study requirements
Before the learner’s second official exam attempt, Orbait’s platform records must show completion of all of the following within the eligible Track:
- At least ten complete Orbait simulations.
- At least two Orbait Final Exam attempts.
- At least fifteen hours of active study use recorded by Orbait.
Active study time is measured by Orbait’s systems and may exclude idle time, an unattended open browser tab, automated activity, duplicate sessions, or activity that cannot reasonably be verified as genuine study use. Orbait’s records will be used to determine whether these requirements were completed, subject to correction of a demonstrated technical error.
Official exam and documentation requirements
- Both failed attempts must be official examinations administered or recognized by the applicable state authority or its authorized testing provider.
- Both attempts must occur after the eligible Orbait purchase and must correspond to the state, Core exam, category, or credential covered by the purchased Track.
- The claimant must submit authentic documentation showing two separate unsuccessful attempts, including the learner’s name, testing authority or provider, exam or category, examination date, and result.
- Unrelated sensitive information may be redacted, but the information needed to verify identity, exam type, date, and result must remain visible.
- Orbait may request reasonable additional documentation to verify the purchase, account holder, examination, attempt dates, or results. Do not send Social Security numbers or complete payment-card numbers.
Submitting and reviewing a claim
A claim must be submitted from the email address associated with the Orbait account by contacting support@orbait.com. The request should identify the eligible Track and include the required proof for both official failed attempts.
- Each claim is reviewed individually by a human and is not approved automatically.
- Verification may require a reasonable review period and may take longer when documents are incomplete, inconsistent, difficult to authenticate, or require additional information.
- Approval depends on satisfaction of all published requirements and successful verification of the account, platform activity, purchase, and exam documentation.
- If approved, Orbait will refund the amount actually paid for the eligible product to the original payment method when reasonably possible. Access to the refunded product may then be removed.
- The Pass Policy does not reimburse state exam fees, training fees, books, travel, lodging, lost wages, employer costs, or any other expense beyond the eligible Orbait purchase.
Claims that are not eligible
The Pass Policy does not apply when:
- The product was not expressly advertised as covered by the Pass Policy at the time of purchase.
- The required simulations, Final Exams, or active study time were not completed before the second official attempt.
- The submitted results concern a different state, category, credential, or exam from the purchased Track.
- An attempt was a practice test, employer assessment, canceled appointment, no-show, incomplete examination, or result unrelated to a failing score.
- The purchase was already refunded, charged back, reversed, transferred, or obtained through unauthorized payment.
- The account involved sharing, automation, copied content, falsified documents, manipulated activity, fraud, or another material violation of these Terms.
Limited right to use the Services
Subject to these Terms and any applicable payment, Orbait grants you a limited, personal, non-exclusive, nontransferable, non-sublicensable, and revocable right to access and use the purchased Services for your own lawful education and exam preparation during the applicable access period.
This is a license to use the Services—not a sale or transfer of Orbait software, questions, explanations, designs, databases, analytics, or intellectual property. No rights are granted except those expressly stated in these Terms.
Orbait intellectual property
The Services and their contents are owned by Orbait or its licensors and are protected by copyright, trademark, trade-secret, contract, and other laws. Protected elements include, without limitation, question banks, answer options, explanations, course structure, simulations, scoring logic, study systems, text, graphics, branding, designs, user interfaces, software, analytics, databases, and compilations.
You may not, without prior written permission:
- Copy, photograph, screen-record, reproduce, publish, translate, distribute, display, sell, license, or create derivative materials from substantial portions of the Services.
- Share questions, explanations, screenshots, exported content, or account access in study groups, employer repositories, websites, social media, messaging platforms, or competing products.
- Use Orbait content to create, improve, benchmark, evaluate, or train another question bank, course, software system, machine-learning model, or AI service.
- Remove copyright, trademark, attribution, watermark, access-control, or proprietary notices.
“Orbait,” the Orbait logo, Galap, product names, slogans, and related branding may be trademarks or service marks of Orbait LLC. No permission to use Orbait branding is granted by purchasing or accessing the Services.
Feedback, reviews, and user submissions
You retain ownership of original content you submit, such as support messages, feedback, reviews, suggestions, or optional profile information. You grant Orbait a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and use that content as reasonably necessary to operate, secure, support, and improve the Services.
If you voluntarily provide ideas, feature requests, corrections, suggestions, or other feedback, Orbait may use that feedback without restriction or compensation, provided we do not publicly identify you in a testimonial or endorsement without appropriate permission.
- Do not submit content that is unlawful, defamatory, threatening, deceptive, infringing, confidential to another party, or invasive of privacy.
- Do not submit recalled, copied, photographed, or confidential content from an official examination.
- You represent that you have the rights needed to submit the content and grant the permissions described above.
AI-assisted features
Orbait may provide AI-assisted explanations, study guidance, weak-area analysis, question support, conversational assistance, or similar features. AI output is generated automatically and may contain errors, omissions, outdated information, or misleading interpretations.
- Use AI output as a study aid, not as the controlling source for laws, labels, safety decisions, emergency response, pesticide application, or official exam rules.
- Verify important information against current labels, manuals, regulations, agency instructions, and qualified professional judgment.
- Do not enter Social Security numbers, complete payment-card numbers, health information, employer secrets, confidential exam content, or unnecessary sensitive information.
- You may not use automated prompts, extraction tools, or repeated queries to reconstruct, export, or reproduce Orbait’s protected content.
Acceptable use and prohibited conduct
You agree not to misuse the Services. Prohibited activity includes:
- Sharing, selling, renting, transferring, or permitting others to use your account or purchased access.
- Using bots, scripts, crawlers, scraping tools, browser automation, bulk capture, data mining, or similar methods to access or extract content.
- Bypassing paywalls, access periods, rate limits, authentication, technical restrictions, or security controls.
- Reverse engineering, decompiling, probing, testing, or attempting to discover source code or nonpublic platform logic except where law expressly permits it.
- Uploading malware, interfering with availability, overloading infrastructure, or attempting unauthorized access to accounts, systems, or data.
- Using the Services for unlawful, fraudulent, deceptive, harassing, discriminatory, dangerous, or rights-infringing purposes.
- Misrepresenting Orbait content as official government material, your own original work, or authorization to perform regulated pesticide work.
- Using content or access in a manner that compromises exam integrity or violates a testing provider’s candidate rules.
Orbait may use reasonable technical and administrative measures to identify suspicious use, including excessive simultaneous logins, abnormal request patterns, automated access, large-scale copying, or activity inconsistent with personal study.
Content updates, features, and availability
Orbait may add, remove, reorganize, correct, or update questions, explanations, features, interfaces, and study paths. These changes may occur because laws, manuals, exams, technology, or educational methods change. Product descriptions identify the principal access purchased but do not guarantee that every feature, question, layout, integration, or AI capability will remain unchanged.
We aim to provide reliable access but do not guarantee uninterrupted or error-free availability. Maintenance, hosting issues, security events, third-party outages, updates, internet conditions, or events outside Orbait’s reasonable control may temporarily affect the Services.
When a material technical problem within Orbait’s control prevents meaningful use of a paid product, contact support. Orbait may provide troubleshooting, an extension, replacement access, credit, or refund when appropriate, subject to applicable law and the circumstances.
Third-party services and external resources
Orbait relies on third-party services for functions such as payment processing, hosting, authentication, security, email delivery, analytics, automation, support, and AI infrastructure. Your use of certain functions may also be subject to the provider’s terms or privacy notice.
The Services may link to regulators, testing providers, manuals, employers, product labels, or other external resources. Orbait does not control and is not responsible for third-party content, availability, accuracy, security, policies, eligibility decisions, fees, or services. A link does not imply endorsement unless expressly stated.
Suspension and termination
You may stop using the Services at any time. Access also ends when the purchased access period expires. Orbait may investigate suspected violations and may restrict, suspend, or terminate accounts or access when reasonably necessary to:
- Protect users, Orbait, providers, intellectual property, exam integrity, or platform security.
- Respond to nonpayment, payment reversal, fraud, legal process, or a credible rights complaint.
- Address account sharing, automation, copying, resale, harassment, unlawful activity, or other material violations.
- Prevent ongoing harm while an issue is investigated.
When reasonable, Orbait may provide notice and an opportunity to correct a nonurgent violation. Immediate action may be taken for security threats, fraud, unlawful conduct, intellectual-property theft, repeated violations, or conduct likely to cause harm. Termination for cause does not require a refund except where law requires otherwise.
Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limits, indemnification, dispute terms, and general provisions—will survive.
Disclaimers
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. Orbait disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, uninterrupted availability, and any warranties arising from course of dealing or usage of trade.
Orbait does not warrant that the Services will contain every topic or question that may appear on an exam; match a particular exam’s wording, difficulty, timing, scoring, or sequence; remain free from errors; or produce a specific educational, licensing, employment, or business result.
Pesticide laws, labels, safety requirements, and professional practices can involve serious risks. Orbait content is educational and does not replace the product label, current law, emergency guidance, required supervision, agency instructions, employer procedures, or advice from a qualified professional.
Limitation of liability
To the maximum extent permitted by law, Orbait and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, business opportunity, employment, certification, data, goodwill, or use; exam fees or retesting costs; or damages arising from reliance on educational or AI-generated content.
To the maximum extent permitted by law, Orbait’s total aggregate liability arising out of or relating to the Services or these Terms will not exceed the amount you paid to Orbait for the product or Service giving rise to the claim during the 12 months immediately preceding the event that created the liability.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not exclude liability that cannot lawfully be limited, including liability for intentional misconduct where applicable law prohibits limitation.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Orbait and its owners, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Services, material violation of these Terms, infringement or misuse of another party’s rights, user submissions, account sharing, redistribution of Orbait content, or compromise of exam integrity.
Orbait will provide reasonable notice of a covered claim and may control the defense and settlement. You may not settle a claim in a manner that admits fault by Orbait, imposes obligations on Orbait, or restricts Orbait’s operations without written consent.
Governing law and dispute resolution
These Terms and disputes arising from them or the Services are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except to the extent another jurisdiction’s mandatory consumer law applies.
Informal resolution first
Before filing a lawsuit, you and Orbait agree to make a good-faith effort to resolve the dispute informally. Send a written notice to support@orbait.com describing the issue, relevant transaction, requested resolution, and account email. Allow 30 days for a response before initiating formal proceedings, unless urgent relief or a legal deadline makes that impracticable.
Courts and small claims
Unless applicable law requires another forum, disputes that are not resolved informally will be brought in a state or federal court with jurisdiction in Connecticut. Either party may pursue an eligible individual claim in small claims court. Nothing in these Terms prevents either party from seeking temporary or injunctive relief to protect security, confidential information, or intellectual-property rights.
General provisions
Changes to these Terms
Orbait may update these Terms to reflect changes in law, technology, features, providers, pricing models, security needs, or business practices. The updated Terms will be posted on this page with a revised “Last updated” date. If a change is material, Orbait may provide additional notice through the Services, by email, at checkout, or through another reasonable method.
Updated Terms apply prospectively from their stated effective date. Your continued use after that date constitutes acceptance where permitted by law. If you do not agree to an update, you must stop using the Services. Changes will not retroactively reduce a refund or access right already earned under the terms applicable at purchase, except where required by law or needed to address fraud, security, or unlawful activity.
